The Adoptions Department at Musyimi deals with the legal elements of the adoption process. After the prospective adopters have fostered the child for 3 months, they need to begin the court process. Our role includes guiding prospective parents in the collation of requisite documentation from the adoption society/ agency. We also help the prospective parents with drafting and filing the relevant applications, conducting the hearings, service of orders to relevant parties, extracting the final orders given and procuring the Adoption Certificate.

We have in the past represented foreign nationals who wanted to adopt a Kenyan child. However, there is an indefinite moratorium on international adoptions of Kenyan children by foreigners as of 24th November 2014.
Kinship adoptions occur when a child is adopted by his/her relatives. This can be because the child is orphaned on his/ her parents are unable to provide the child with care and protection. The procedure is similar to that of adoption of a child from a children’s home. In this kind of adoption, strict proof of the fostering period of three months is not required; it is assumed that the adoptive parents are already bonded by kinship.
Legal guardianship is the process where an applicant acquires parental responsibility for a child until they reach 18 years of age. This can be obtained through a deed or will be made by a parent before his or her death, or through a court order. Guardianship does not alienate the child from his or her birth parents it only bestows upon the guardian parental responsibility over the child.
We offer advice and representation to clients who would want to obtain guardianship orders. We also provide guidance in the provision of guardianship by a will so as to ensure that upon the death of a parent, the child is left with someone to take care of them.
